Arbitration and mediation

ARBITRATION - resolution of a dispute between contractual partners with the help of legal means which is, in comparison with the classic legal proceedings, less time consuming and also less expensive. The decision is not made by the court but by one ore more arbitrators. Based on the agreement of the contractual parties it is possible to solve any disputes in front of an arbitrator. The disputes must fulfil the following conditions:

• Disputes of proprietary character
• The parties can compromise about the matter of the dispute, thus settle a lawsuit amicably
• The disputes are not caused by a distrainment or bankruptcy

Arbitration can be thus used in a large number of cases in business relation, common pleas and also disputes between employers and employees.

MEDIATION – a method of conflict resolution by an agreement. The dispute is analysed and assessed by an independent person – the mediator, which leads to a situation when the parties of the dispute can reasonably communicate about the problem and solve it.
